birtamod.online provides a marketplace platform model that connects vendors and buyers across Nepal. We do not sell products directly; instead, we provide the infrastructure and tools for vendors to list products and for buyers to purchase from vendors.
birtamod.online holds patent rights over its business structure model and services, including the name "birtamod.online." Unauthorized use of our business model, name, or proprietary systems is strictly prohibited.
You must be at least 18 years old or the age of legal majority in Nepal to use this Platform. By using the Platform, you represent that you meet these requirements.
Vendors may be required to provide: - Valid business registration documents - Tax identification numbers (PAN) - Bank account information for payments - Government-issued identification - Any other documents we deem necessary for verification
birtamod.online operates as a platform provider only. We: - Provide the technology infrastructure for the marketplace - Facilitate connections between vendors and buyers - Process payments on behalf of vendors - Provide customer support and dispute resolution services - Offer advertising and promotional services
We do NOT: - Sell products directly to buyers - Take ownership or possession of vendor products - Guarantee the quality, safety, or legality of products listed - Guarantee the accuracy of vendor listings - Assume responsibility for vendor-buyer transactions beyond our platform services
All purchases and sales are direct transactions between vendors and buyers. Vendors are responsible for: - Product listings and descriptions - Product quality and authenticity - Inventory management - Order fulfillment and shipping - Customer service for their products - Compliance with applicable laws
Vendors must: - Provide accurate product descriptions and images - Set fair and transparent pricing - Maintain adequate inventory - Fulfill orders promptly - Provide accurate shipping information - Respond to buyer inquiries within 48 hours - Honor refund and return policies - Comply with all applicable laws and regulations
Vendors may NOT sell: - Illegal items or items that violate Nepal law - Counterfeit, stolen, or unauthorized goods - Weapons, explosives, or hazardous materials - Drugs, controlled substances, or prescription medications - Tobacco or alcohol (unless properly licensed) - Adult content or services - Items that infringe intellectual property rights - Any items we deem inappropriate at our sole discretion
Buyers must: - Provide accurate shipping and contact information - Complete payment for orders placed - Review product descriptions carefully before purchasing - Contact vendors directly for product-specific questions - Follow the returns and refunds policy of the respective vendor
Each vendor establishes their own return and refund policies, which must: - Be clearly stated in their vendor profile - Comply with applicable consumer protection laws - Be honored by the vendor
Fraudulent chargebacks may result in: - Account suspension or termination - Legal action - Reporting to relevant authorities
Basic platform access and standard vendor/buyer accounts are free.
Our business generates revenue through: - Targeted Advertising: Vendors and third parties may purchase ad placements - Paid Features: Enhanced listings, premium vendor accounts, analytics tools - Recurring Subscriptions: Monthly/annual plans for advanced features - Commission Fees: Percentage of successful transactions
All intellectual property in the Platform, including but not limited to: - Platform design, layout, and functionality - Business model and operational structure - The name "birtamod.online" - Logos, trademarks, and branding - Software, algorithms, and code
are owned by or licensed to birtamod.online and are protected by intellectual property laws.
birtamod.online holds patent rights over its business structure model and services. Any unauthorized use, reproduction, or implementation of our patented business model is strictly prohibited and will result in legal action.

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We do not warrant that: - The Platform will be uninterrupted or error-free - Defects will be corrected - The Platform is free from viruses or harmful components - Information on the Platform is accurate or reliable
WE ARE NOT RESPONSIBLE FOR: - The quality, safety, or legality of products listed - The accuracy of vendor listings or descriptions - The ability of vendors to fulfill orders - The ability of buyers to complete purchases - Any direct transactions between vendors and buyers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BIRTAMOD.ONLINE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM.
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE SIX MONTHS PRECEDING THE CLAIM, OR NPR 10,000, WHICHEVER IS LESS.
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such cases, our liability will be limited to the maximum extent permitted by law.
You agree to indemnify, defend, and hold harmless birtamod.online and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or related to: - Your use of the Platform - Your violation of these Terms - Your violation of any rights of third parties - Your content or products listed on the Platform
You may terminate your account at any time by contacting us or using account settings. You remain liable for all activities before termination.
We may suspend or terminate your account immediately without notice if: - You violate these Terms - You engage in fraudulent or illegal activity - Your account has been inactive for an extended period - We discontinue the Platform - We determine termination is necessary at our sole discretion
Upon termination: - Your right to use the Platform ceases immediately - Outstanding obligations remain in effect - We may delete your account and content - Provisions that should survive termination will continue to apply
These Terms are governed by the laws of Nepal, without regard to conflict of law principles.
You agree to submit to the exclusive jurisdiction of the courts located in Jhapa District, Nepal for resolution of any disputes.
Before filing any lawsuit, parties agree to attempt resolution through good-faith negotiation. If negotiation fails, disputes may be submitted to binding arbitration in accordance with Nepal Arbitration Act, 1999.
You agree to resolve disputes individually and waive any right to participate in class action lawsuits or class-wide arbitration.
We reserve the right to modify these Terms at any time. Changes will be effective: - Immediately upon posting for new users - 30 days after posting for existing users
We will notify users of material changes via email or Platform notification. Continued use of the Platform after changes constitutes acceptance of the modified Terms.
These Terms, together with our Privacy Policy and any additional agreements, constitute the entire agreement between you and birtamod.online.
If any provision is found to be unenforceable, the remaining provisions will remain in full effect.
Our failure to enforce any right or provision does not constitute a waiver of that right or provision.
You may not assign these Terms without our written consent. We may assign these Terms without restriction.
We are not liable for any failure to perform due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, network infrastructure failures, strikes, or shortages of transportation facilities, fuel, energy, labor or materials.
These Terms are written in English. Any translations are provided for convenience only. In case of conflict, the English version prevails.
